Terms and Conditions for the caKao App

Welcome to caKao™, a wellness app that helps you understand how you really look and feel through three features: a daily GlowScore™ based on your mood and energy, exercise and movement tracking with calorie estimates, and meal logging with a HealthScore™ for the food you eat. By downloading, accessing, or using the caKao app or website ("App" or "Service"), you agree to these Terms and Conditions ("Terms"). If you do not agree, please do not use the App. These Terms form a binding agreement between you ("User" or "you") and caKao Inc. ("Company," "we," "us," or "caKao"), a company incorporated in Singapore.

1. About caKao

caKao is an entertainment, motivation, and self-reflection app. It is not a medical app, a mental health service, a nutrition or fitness program, a diagnostic tool, or a substitute for professional advice of any kind. The GlowScore, HealthScore, calorie estimates, exercise tracking, meal analysis, smart hints, taglines, and any other content generated by the App are for personal reflection and entertainment only.

caKao does not diagnose, treat, or prevent any medical, psychological, dietary, or fitness condition. All numbers and scores the App produces are estimates, not measurements. If you have questions about your physical or mental health, your diet, your exercise routine, or any medical concern, please consult a qualified healthcare or fitness professional.

2. Acceptance of Terms

You must be at least 13 years old to use caKao. Users between 13 and the age of majority in their jurisdiction must have a parent or guardian's consent before using the App.

By using caKao, you agree to these Terms and to any future updates we publish at https://www.cakao.ai/terms-and-conditions or notify you about in the App. We may update these Terms from time to time to reflect new features, legal requirements, or improvements to the service. Continuing to use caKao after an update means you accept the new Terms.

3. Your Account

To use caKao you sign in with your Apple ID or Google account. You will be asked to provide profile information such as your age, gender, and optionally cycle, height, and other personal details so the App can personalize your experience.

You are responsible for the activity on your account and for keeping your sign-in credentials secure. If you believe your account has been accessed without permission, contact us at team@cakao.ai right away.

4. How caKao Works

4.1 What the App Does

caKao has three main feature areas. You can use any combination of them.

GlowScore (daily vibe check-in). You answer simple daily questions about how you are feeling, including your mood, stress, sleep, optional notes, and (if relevant) skin, hair, cycle, or appearance. Based on what you share, the App returns a GlowScore (a personal vibe metric on a 1 to 10 scale), a smart hint (a short, kind reflection), and a tagline (a short, shareable phrase).

Moves (exercise and movement tracking). You can log workouts and physical activities manually, and the App estimates the calories burned based on the activity type, duration, and your profile. You can also connect Apple Health (on iPhone) or Android Connect (on Android) to automatically sync your activity data. See Section 4.4 for details.

Meals (food logging with HealthScore). You can scan a photo of your meal or describe it in text, and the App estimates the food's calorie content, macronutrients (protein, carbs, fat), and assigns a HealthScore (a 1 to 10 nutritional quality estimate unique to caKao).

All outputs from caKao are generated using AI. They are not medical, psychological, nutritional, or fitness advice.

4.2 AI Providers We Use

In addition to the advanced AI models we have developed in-house, caKao also uses AI services from OpenAI and Anthropic to generate personalized content.

For GlowScore check-ins: the text of your check-in (your mood, stress, sleep, notes, and any optional fields you provided) is processed by our in-house models and may also be sent to OpenAI or Anthropic's servers for processing.

For meal scanning: when you scan a photo of your meal, the image is processed by our in-house models and may also be sent to OpenAI's vision model (GPT-4o vision) or Anthropic's Claude vision model for analysis. The AI returns an estimated breakdown of calories, macronutrients, and a HealthScore, which we return to you.

For meal text descriptions and exercise calorie estimates: text is processed by our in-house models and may also be sent to OpenAI or Anthropic.

Our third-party AI providers process this data on our behalf under their respective enterprise data policies and do not use your content (text or images) to train their public models.

We may add, change, or rely more heavily on our in-house models or third-party providers over time. We will update these Terms and the Privacy Policy if there are material changes.

4.3 Meal Photo Handling

When you scan a meal photo, the photo is sent to our backend and to our AI vision providers for analysis. We store the photo with your meal history for 14 days, so you can see your meal log with images. After 14 days, the photo is automatically deleted from our systems.

The text analysis results (calories, macros, HealthScore, description) are kept with your meal history for as long as your account is active, since these are the values you want to track over time.

You can delete any meal entry and its photo manually from the App at any time.

4.4 Apple Health and Android Connect

caKao can optionally sync data from Apple Health (iOS) or Android Connect (Android) into the Moves section of the App.

You must explicitly grant permission in your device settings before any sync happens. caKao cannot access this data without your approval.

What caKao reads from Apple Health and Android Connect:

  • Calorie burn (active energy)

  • Workout duration

  • Step count

What caKao does NOT read:

  • Heart rate, blood pressure, sleep tracking, weight, body measurements, glucose, menstrual cycle data, or any other health metrics

  • Any data not listed above

What caKao writes back:

  • Nothing. caKao does not write any data to Apple Health or Android Connect. The integration is read-only.

You can revoke caKao's access to Apple Health or Android Connect at any time in your device settings. When you revoke access, no further sync happens. Data previously synced into caKao stays in your caKao account until you delete it or your account.

4.5 Crisis Detection and Safety

To keep caKao a safe and appropriate space, the App includes a safety feature that detects content suggesting a mental health crisis, self-harm, harm to others, hatred against protected groups, or other extreme situations. When this is detected:

  • The App will not return a normal GlowScore, HealthScore, or tagline

  • Instead, the App will show a brief notice reminding you that caKao is for entertainment only and is not a medical or mental health service, and encouraging you to seek help from a qualified provider

The App may also pause your check-ins for a short period of time if it detects repeated concerning content, to give you space to step away from the App and seek real support if you need it.

This safety feature is automated and is not a substitute for professional help. If you or someone you know is in crisis, please contact a qualified healthcare provider, a local crisis service, or emergency services in your area immediately.

4.6 Estimates and Accuracy

Every number caKao produces is an estimate. This includes:

  • GlowScore values

  • HealthScore values

  • Calorie counts (food and exercise)

  • Macronutrient breakdowns

  • Activity duration and intensity estimates

  • Any other metric the App calculates

These estimates use AI and best-effort algorithms based on the information you provide and on data synced from Apple Health or Android Connect. They are not measurements, they are not medically accurate, and they can be wrong, sometimes significantly.

Do not use caKao's estimates for medical reasons. Do not use them to manage a medical condition, dose medications, follow a prescribed diet, or make any decision where accuracy matters. If you need accurate calorie or nutritional information, consult a registered dietitian, doctor, or other qualified professional.

4.7 Your Conduct

You agree to use caKao for personal, non-commercial purposes and to not:

  • Use the App for any unlawful purpose

  • Upload content (text or images) you do not have the right to share, or content that infringes someone else's rights

  • Upload images that contain other people without their consent, illegal content, or content that violates community standards

  • Attempt to disrupt, hack, reverse-engineer, or scrape the App or our infrastructure

  • Use automated tools to access the App without our written permission

  • Impersonate another person or misrepresent your identity

5. Your Data

5.1 What We Collect

We collect:

  • Information you provide during check-ins (mood, stress, sleep, optional notes, and any health-related fields you choose to share, including cycle, skin, hair, or appearance details)

  • Information you log in Meals (text descriptions, photos, and the AI's estimated calorie and macronutrient values)

  • Information you log in Moves (workouts, duration, and the AI's calorie burn estimates)

  • Data synced from Apple Health or Android Connect (calorie burn, workout duration, step count), only if you have granted permission

  • Basic profile information (age, gender, optional details)

  • Technical data needed to operate the App (device info, app version, error logs, etc.)

5.2 What We Do With It

Your data is used to:

  • Provide the Service (generate your GlowScore, HealthScore, smart hints, calorie estimates, and personalized features)

  • Improve caKao (fix bugs, develop features, measure how the App is performing)

  • Keep the Service safe (detect and prevent abuse, fraud, and crisis content)

  • Comply with legal obligations

5.3 What We Do NOT Do

caKao does not sell your data. caKao does not share your data with third parties for analytics, advertising, marketing, or profiling.

This includes your health-related data such as cycle, skin, hair, mood, stress, sleep, personal notes, meal photos, food descriptions, exercise logs, and data synced from Apple Health or Android Connect. This information stays within caKao's systems and is only sent to our AI processing partners (OpenAI and Anthropic) as needed to generate your check-in, meal, or exercise response, under contracts that prohibit them from using it for their own purposes.

Period and cycle data, in particular, is retained within caKao and is not shared with any third party for advertising, analytics, profiling, or any commercial purpose.

Data synced from Apple Health or Android Connect is used only inside the Moves feature of caKao. It is not used for advertising, not shared with any third party, and not used to train AI models.

5.4 Account Deletion

You can delete your account at any time from the App's settings. When you do, we will delete your personal data in accordance with our Privacy Policy and applicable law. Some information may be retained for legal compliance, fraud prevention, or backup purposes for a limited period before final deletion.

6. Subscriptions and Payments

6.1 Free and Premium Tiers

caKao offers both free access and a premium tier called caKaoPRO. Premium features may include enhanced personalization, expanded language support, additional meal scans, additional content, and other features we add over time.

6.2 How Payment Works

Subscriptions are processed through the in-app purchase system of the platform you use:

  • On iPhone and iPad, payments go through Apple's in-app purchase system. We do not see or store your payment card information. For billing questions, refunds, or subscription management on Apple, please use your Apple account settings or visit https://support.apple.com/billing.

  • On Android, payments go through Google Play's billing system. We do not see or store your payment card information. For billing questions, refunds, or subscription management on Google Play, please use your Google account settings or visit https://support.google.com/googleplay.

6.3 Renewals and Cancellation

Subscriptions automatically renew at the end of each billing period unless you cancel.

  • On Apple devices, you can cancel anytime through your Apple account settings. Apple's refund policies apply to all Apple in-app purchases.

  • On Android devices, you can cancel anytime through your Google Play account settings. Google's refund policies apply to all Google Play purchases.

Cancellation takes effect at the end of the current billing period. We do not provide pro-rated refunds for partial billing periods.

6.4 Pricing Changes

If we change subscription pricing, we will notify you in advance through the App or by email. The new price takes effect at your next renewal, and you can cancel before then if you do not wish to continue.

7. Intellectual Property

caKao's name, logo, design, content, software, AI prompts, and the GlowScore and HealthScore concepts are owned by caKao Inc. and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, reverse-engineer, or create derivative works from caKao without our written permission.

caKao™ and GlowScore™ are trademarks of caKao Inc. All other trademarks are the property of their respective owners.

Features designed for sharing (such as a tagline image you can post to social media) may be used for personal, non-commercial purposes as intended.

8. Termination

We may suspend or terminate your access to caKao at our discretion if you violate these Terms, abuse the Service, or pose a safety or security risk. We may also discontinue features or the entire Service over time. You may stop using caKao or delete your account at any time.

9. Disclaimers

caKao is provided "as is" and "as available." We do not promise that the App will be uninterrupted, error-free, or perfectly accurate. AI-generated content can be wrong, inconsistent, or unexpected. This is especially true for calorie estimates, macronutrient breakdowns, HealthScore values, and exercise calorie burn estimates, which can be significantly inaccurate. Please use your own judgment.

We expressly disclaim any warranty that the App is suitable as a medical, psychological, nutritional, dietary, or fitness tool. caKao is for entertainment and self-reflection only.

10. Limitation of Liability

To the maximum extent allowed by law, caKao Inc. is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the App, including but not limited to lost data, lost time, emotional distress, health-related consequences, dietary consequences, or fitness-related consequences. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose, or USD $100, whichever is lesser.

Nothing in these Terms limits liability that cannot legally be limited under applicable law.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of Singapore. Any disputes arising from these Terms or your use of caKao will be resolved through binding arbitration in Singapore under the rules of the Singapore International Arbitration Centre (SIAC), with a single arbitrator. You agree to bring claims individually and not as part of a class action.

If you are a consumer in a jurisdiction that gives you mandatory rights that cannot be waived, those rights still apply.

12. General Terms

Entire Agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and caKao regarding the App.

Severability. If any part of these Terms is found to be unenforceable, the rest stays in effect.

No Waiver. If we don't enforce a provision of these Terms in one situation, that doesn't mean we waive our right to enforce it later.

Assignment. You may not transfer your rights under these Terms. We may assign or transfer our rights as part of a business transaction (such as a merger or acquisition), in which case we will notify you.

Language. These Terms were drafted in English. Translations are provided for convenience only; the English version controls in case of any conflict.
