Our sophisticated machine learning architecture delivers adaptive insights and predictive analytics to transform how users engage with their health and wellness journey. By downloading, accessing, or utilizing the caKao application ("App"), you acknowledge and agree to be legally bound by these Terms and Conditions ("Terms"). Should you disagree with any provision herein, you must immediately discontinue use of the App. These Terms constitute a binding legal agreement between you ("User" or "you") and caKao Inc. ("Company," "we," "us," or "caKao"), a technology corporation incorporated under the laws of Singapore.

1. Acceptance of Terms

Platform access requires verification that users meet minimum age requirements of thirteen (13) years or possess explicit parental authorization for minors to engage with our AI-powered health analytics platform.   • Uploading, transmitting, or distributing content that contains defamatory material, factually inaccurate information, or constitutes infringement upon intellectual property rights or proprietary interests of third parties.

  • Engaging in any form of system interference, including but not limited to unauthorized penetration testing, deployment of malicious code, introduction of viral agents, or any activities that compromise the integrity of our secure infrastructure.

  • Utilizing automated data extraction tools, web scraping technologies, robotic process automation, or any systematic data harvesting methodologies to access, retrieve, or replicate proprietary platform data without explicit written authorization.

3. App Features and Limitations

4.3 Cancellation

Users are strictly prohibited from reproducing, distributing, reverse-engineering, or creating derivative works based upon our proprietary assets without express written authorization from caKao's legal department. This restriction encompasses all platform elements except for specifically designated sharing functionalities, such as meal analysis link distribution features that are explicitly enabled within our authorized user experience framework.

7. Termination

caKao reserves the unilateral authority to suspend, restrict, or permanently terminate user access to our platform infrastructure at our sole discretion, with or without prior notification, in response to Terms violations, security concerns, operational requirements, or strategic business decisions including platform lifecycle management. Upon account termination, user profiles and associated data repositories may be subject to permanent deletion in accordance with our data retention policies and applicable privacy regulations. You may delete your account at any time via the App’s settings.

8. Disclaimers and Limitation of Liability

The caKao platform is delivered on an "as is" and "as available" basis without any warranties, representations, or guarantees of any nature, whether express, implied, statutory, or arising from course of dealing or trade usage. This includes, without limitation, any warranties of merchantability, fitness for a particular purpose, accuracy of AI-generated analytics, system reliability, data integrity, or non-infringement of third-party intellectual property rights. caKao expressly disclaims any assurances regarding uninterrupted service availability, error-free operational performance, or compatibility with all device configurations and operating environments. Users acknowledge and accept that platform engagement involves inherent technological risks and assume full responsibility for any consequences arising from their utilization of our AI-powered services and recommendations.

8.2 Limitation of Liability

To the fullest extent permissible under applicable jurisdictional statutes and regulatory frameworks, caKao Inc., its corporate affiliates, technology partners, and subsidiary entities shall bear no legal responsibility or financial obligation for any indirect, incidental, consequential, punitive, or exemplary damages, including but not limited to data loss, system interruptions, health-related complications, business disruption, or lost revenue streams arising from or connected to platform utilization, AI-generated recommendations, or service delivery. Our aggregate liability exposure for all claims, demands, or causes of action shall be strictly limited to and shall not exceed the total monetary consideration remitted by the user for platform services during the twelve (12) month period immediately preceding the incident giving rise to such claim.

9. Governing Law and Dispute Resolution

These Terms and Conditions are governed exclusively by the legal frameworks and statutory provisions of the Republic of Singapore, without application of conflict of laws doctrines or principles. Any disputes, controversies, or claims arising from or relating to these Terms, platform utilization, or service delivery shall be resolved through mandatory binding arbitration proceedings conducted in Singapore under the comprehensive arbitration rules and procedures of the Singapore International Arbitration Centre (SIAC). Arbitration proceedings shall be presided over by a single qualified arbitrator appointed in accordance with SIAC protocols.
